Any non-authorized use of a protected brand or logo constitutes an offense of counterfeit and may be taken to the legal authorities.

3 –  Intellectual property rights

The present website and all of its content, including texts, still or animated images, databases, programs, scripts, etc., hereinafter called the website, are the property of INDEXPLUS.

In virtue of the rules pertaining to intellectual property, any reproduction (including by downloading, printing, etc.), representation, adaption, translation, transformation and/or transfer to another site of one or several of the aforementioned elements is forbidden without the prior written authorization of INDEXPLUS and/or the rights holder. Any non-authorized use of this content constitutes an offense of counterfeit and may give rise to civil and/or criminal legal proceedings and to the payment of damages and interest.

INDEXPLUS grants you only the authorization to view its content for personal and private purposes or for professional purposes, excluding all public diffusion or visualization. Rights of reproduction are granted to you only digitally on your computer in order to view the pages opened by your browser. Paper print outs are authorized for private purposes, for the exclusive use of the copyist.

You acknowledge that you accept that the INDEXPLUS site may present some inexact information as concerns its content. The responsibility of INDEXPLUS cannot be engaged due to direct or indirect, consequential or incidental, damages resulting from the use of the site or any information obtained from the site. INDEXPLUS shall not be held responsible if any of the ideas or images contained on the site offend any particularly sensitive person.

The INDEXPLUS website is accessible 24/7. INDEXPLUS shall not be held responsible should there be any technical impossibility of accessing this site, whether this be due to a case of force majeure, a maintenance operation, an editorial update, an external or internal strike, a network breakdown or electricity blackout, poor configuration or use of the user’s computer or any other cause that depends or does not depend on INDEXPLUS.

The speed and rate of the transfer of data from the INDEXPLUS server to the Internet network is not guaranteed by INDEXPLUS. INDEXPLUS cannot guarantee that the server and the site are free of viruses. INDEXPLUS cannot be held responsible in the event that your IT material is infected by a virus.

7 –  Disputes

The present website was created in Belgium. By using the present website, you accept the conditions of use described above, without prejudice of any recourse of a contractual or tortious nature that may be exercised by INDEXPLUS.

Any dispute bearing on the interpretation or execution of a contractual commitment provided for in the present site will be in the exclusive competence of Belgian courts applying Belgian law. Any reproduction of the present website or of any of its elements is forbidden.

8 –  Warning

INDEXPLUS reserves the right to limit or cancel access to its services that require login details in the event that these terms and conditions are not respected or in the event of a lawsuit filed against it. INDEXPLUS reserves the right to deny access to its site to any user who:

• publishes on the site any messages of a promotional or advertising nature, messages that are contrary to public order or public decency, or which are racist, genocide denying, apologies for war crimes, insulting or crude, violations of copyright or similar rights, violations applicable to laws governing databases, trademarks, image rights, privacy rights or which would violate any other legislation or regulations in effect.
• creates excess strain on the server, notably by using the site to send unsolicited advertisements.

The fact that one or several provisions in the terms and conditions may be declared null and void by a court decision does not affect the other provisions.

9 –  Jurisdictional competence and applicable law

The present terms and conditions are subject to Belgian law. Any dispute concerning their interpretation or execution falls under the exclusive jurisdiction of the competent Belgian jurisdiction.
